Worker’s Compensation

 

A motion to stay enforcement of an order awarding worker’s compensation benefits will not be granted unless it is shown that irreparable damage must ensue to the employer unless a stay is issued.  A.S.C.A. § 32.0652. Star-Kist Samoa, Inc. v. Commissioner, 1 ASR3d 24 (1997).

 

The fact that the employer might have difficulty recovering the repayment of compensation from the employee if the award to the employee is reversed on appeal, is insufficient reason to grant a stay.   Star-Kist Samoa, Inc. v. Commissioner, 1 ASR3d 24 (1997).
